Children brands who utilize AIMS360 apparel software, use the fashion ERP to comply with consumer protection laws.
Section 103 of the Consumer Protection Safety Improvement act (CPSIA) requires all products intended for children 12 years or younger to have a permanent tracking label. Tracking is important for recall effectiveness. Every month hundreds of products including all types of apparel is recalled by the Consumer Product Safety Commission and listed on their recall list.
How does AIMS360 apparel software track products?
AIMS360 fashion software utilizes a tracking number system that can be connected on the production side and sales side for tracking. This means that the fashion software’s tracking can be used when manufacturing, purchasing from a vendor, working with contractors, or customer orders.
What is required on children’s clothing labels by law?
- Country of Origin: The label should reflect the product’s final processing stage even though it may have components from multiple countries.
- Manufacturing Date: This can be confusing because depending on process and batch size dates vary. Most companies use an exit factory or in warehouse month and year even though they may be finished before that date. This date can be found in AIMS360 apparel ERP in cut tickets, vendor PO’s, or garment dye.
- Cohort MPT ID: Master production tracking is a batch number that can be generated out of AIMS360 or entered (if you have pre-printed labels) and connected to any customer orders, production job, or Vendor PO. This makes the tracking possible.
- Permanent Affixation: A label, both visible and legible, should be printed or etched onto the product to be considered permanent. Adhesive paper labels would not be considered permanent. CPSC says “to the extent practicable”, which suggests either on the product itself or on the packaging. Almost all infant and kids size clothing like t-shirts, onesie, pants, dresses, etc. all have enough space to put a label right on the product. Small children’s accessories and small children’s jewelry that cannot be labeled on the item level will need to have a labeling on the packaging.
We asked expert fashion industry lawyers Nicholas A. Rozansky and Joseph Rothberg of Brutzkus Gubner about the subject. They said, “Being able to track is a requirement under the Consumer Product Safety Improvement Act – which requires that Children’s Products have a tracking label on them. See //www.cpsc.gov/Business–Manufacturing/Business-Education/tracking-label. But in addition to these tracking issues, and other issues which come from the Consumer Product Safety Improvement Act, limiting and dealing with other areas of liability can be greatly improved with a good tracking system in place. For example, electronic tracking software which allows for accurate product tracking by SKU can also help a company more accurately deal with Proposition 65 requirements in California, or assist a company in accurately identifying goods in a trademark or copyright dispute. Being able to quickly and accurately identify separate portions of inventory is one of the very best things a company can do to limit liability and decrease its attorney’s fees in connection with discovery in litigation. This is especially important when dealing with thousands of individual units of Children’s Products. Being able to confidently identify “the units at issue” in a legal dispute can greatly help limit legal liability.”
